and commerce that creates good jobs. >> some better than expected news north of the border with the labor department reporting the unemployment raid dropped to 7.5%, the lowest level in five years, amid signs more people were finding jobs. in addition to april's gains of 165,000 new jobs, the government revised its february and march numbers upward, by a total of 114,000 jobs. >> we are gaining jobs, over 160,000 new jobs. unemployment has ticked down. that's good news. >> rick: still there were major warning signs the economy is struggling. the manufacturing structure created not a single job. construction employment fell for the first time in a year. the commerce department says manufacturing jobs fell. many are unable to find jobs. >> we need to have more people working, more taxpayers. not raising taxes.

we could do it if not for that this drag of the health care law. >> rick: they said it's time toned the sequester cuts and in his remarks to young people at the anthropology museum, the president spoke of more government spending won't sides of the border. >> together let's remember that every dollar, every peso that we invest in research and development, returns so much more to our economies in jobs and opportunity, no products, new services. >> rick: a particular soft spot fort president is youth unemployment, with the new jobs report showing the effective unemployment rate for young people. if you include those when have given up looking for work is 16.1%, the highest level since world war ii. >> our generation is graduating college, we've got all these skills and passion, all this desire to make a difference and we're coming to an economy that's stagnant, has no new jobs and little opportunity for us.

>> administration says in the weeks ahead, we'll see the president back on the road in the u.s. talking about jobs and the economy. >> traveling with the president, thank you. the jobs report prompted another surge on wall street where the dow went to a place had t had never gone before. it crossed the 15,000 mark early in the day. it finished up 142. the s & p gained 17. nasdaq closed ahead 38. fox business news anchor melissa francis has the break down. was the jobs report that good? >> it wasn't that good. it was just right. what that means is it was better than expected. so it means the economy isn't falling off a cliff, which some people were concerned about. but it wasn't so great that it means the fed is going to get out of the market. they've been out there buying up treasuries, keeping interest rates low. that's what sends investors into the stock market 'cause really there is no other place to get a

return. so it fuels the stock market, it was just right in investors' opinion. >> for anybody out there with a 401(k), stocks any connection to the markets? do you foresee they'll continue to go up? >> is the stock market going to keep going up? yeah, that's the question. there is a phrase out there that's very famous on wall street. don't fight the fed. they have all the money, they have all the control and as long as they're out there pushing money into the system, investors feel pretty safe to go on the market. a lot of people think it will continue to go up. but they have signaled that when unemployment falls below 6 1/2% or they see any inflation, that's when they're going to back off. a lot of people are afraid investors will run for the exit. but that's a long way off. >> thank you for the update. the news is not so good across the pond. the european union says the recession in the euro zone is going to get worse before it gets better. it predicts economyies will shrink this year, much worse than earlier forecast.

unemployment hit record highs with more than 19 million people out of work. there are new indications tonight that the obama administration tried to minimize perceptions that middle eastern extremists were behind last fall's benghazi terrorist attack. james rosen has the latest from the state department. >> a solemn state department event honored eight diplomats and other americans who died while supporting america's diplomatic missions overseas and includes the 25-year-old from illinois killed in afghanistan last month. and the four casualties of the benghazi terrorist attacks. u.s. ambassador to libya, chris chris stevens and three others. >> thanks to their bravery and sacrifice, 30 americans escaped the attack. >> at the same time, what the u.s. government knew about the benghazi attacks and withheld from the american people emerged more clearly. the weekly standard published excerpts of classified documents from the drafting process that

yielded the false talking points that u.n. ambassador susan rice delivered on five sunday shows on september 16, five days after the attacks. >> the best assessment we have today is that, in fact, this was not a preplanned, premeditated attack. >> two days earlier the standard report says c.i.a. draft of the talking points stated, quote, the crowd almost certainly was a mix of individuals from across many sectors of libyan society. that being said, we do know that islamic extremists with ties to al-qaeda, participated in the attack. four days later, jay carney insisted no one in the government had such knowledge. >> our initial information, and that includes all information -- we saw no evidence to back up claims by others that this was a preplanned or premeditated attack. >> the standard identified further revisions to the talking points made by officials at c.i.a. and the white house. in part at the insistence of then state department spokeswoman victoria newnd

la who complained some deletions weren't sufficient to build leadership. today a spokesman accused fox news and other news organizations of building a mythology around benghazi, by reporting, among other things, that the special panel known as the arb, which then secretary of state hillary clinton convened to review the attacks, is itself now under review by the office of inspector general. >> when you say investigation, it means the aig is looking into criminal activity. this is a simple review of the process and our follow through of the implementation of the benghazi recommendations. >> the only benghazi specific piece is to look at how the recommendations are being implemented. >> state again hailed the arb's final report on benefiting as comprehensive, despite the fact that secretary clinton was not interviewed by the panel, nor was at least one of the seven members of the global response staff that raced to the scene of the attack, nor was a pair of career state department employees, unnamed whistle

blowers who will testify before congress next week. >> why was secretary clinton not interviewed? >> i don't know. i'd have to refer you to the folks on the arb. >> in addition, the special ops whistle blowers, interviewed by adam housley told fox news that a firm stand down order previously undisclosed was issued that night to special ops personnel who were stationed in tripoli, a separate stand down order which we reported back in october, had involved c.i.a. personnel, the one surfacing now is said to have been issued by a lieutenant colonel on duty in tripoli that night. of the five special ops forces who received it, we are told two delta members not under the colonel's man disregard it. still more details will emerge next week when the two self-styled state department whistle blowers appear before the house oversite committee, chaired by darrell issa of california, a frequent critic of the obama administration. also the senate may vote on the u.s. diplomat who has been named to succeed chris stevens in libya. shannon. >> pulling together a number of

different threats in a complex story. thank you. a shakeup in security over the boston marathon bombings. catherine herridge is on that story again tonight. >> one day after homeland security officials confirmed that azamat tazhayakov, a student from kazakhstan was charged with destroying evidence in the boston marathon bombing, a major security change was ordered at the borders. effective immediately, customs agents must verify every foreign student entering the u.s. has a valid student visa. he with drew from classes january 4 and reentered the u.s. two weeks later because customs was never notified of the change. former homeland security officials say policing student visas more than 500,000 issued in 2012, is a chronic problem. >> the custom border says your visa is expired, now you have to do something with that. who enforces that. there has to be much better cooperation.

>> investigators interest is intensifying on katherine russell. >> it is quite possible she might not have known. but it raises the question as to what did she know and what was their relationship at the time? >> two sources familiar with the investigation tell fox news katherine russell communicated with her husband, tamerlan, after the bombing. one source said it included at least one phone call, with the second source describing an e-mail possibly containing an attachment which included a surveillance photo released by the f.b.i. >> she had a conversation with him after the event, after the bombing of the marathon and she had conversations with him before hand. she lived with him. she saw his change in attitude. she's got some explaining to do or at least some very difficult questions to answer. >> today the u.s. attorney's office in massachusetts confirmed that searches in dartmouth another the dorm room of dzhokhar tsarnaev are connected to the bombing

good evening, molly. >> good evening. the jury, up seven women and five men, asked the judge to help them remember the differences between the four babies that doctor gosnell is accused of murdering. for example, what movement did each baby make after the abortion. before gosnell, or an assistant, according to the prosecution, cut their spinal cord with scissors. this may mean the jury is getting to the crux of the first-degree murder case, were they born dead or alive? and then this afternoon, the jury asked about some of the lesser charges relating to gosnell and his abortion clinic in west philadelphia. charges relating to conspiracy and running a corrupt organization. leading some court watchers to surmise jurors may be moving quickly through the hundreds of charges in this case. but today gosnell's defense attorney and the assistant district attorney played it safe. >> there is a lot of evidence and juries want to get it right. they want to make sure that they're deciding it on the right

>> shannon: america's biggest conventional bomb has apparently been custom tailored to reach iran's nuke site. jennifer griffin has the specifics from the pentagon tonight. >> a year ago, the world's largest bunker buster bomb had a problem. it couldn't, as advertised, dig deep enough into the ground to destroy, for instance, iran's buried nuclear facilities. the 30,000-pound bomb, known as a massive ordinance pen traitor, or mop, needed to be rebuilt. it needed new guidance systems and new fuses to allow the weapon to burrow deeper before exploding. u.s. defense sources confirm the pentagon has now fixed the problem. >> the bigger the bomb, the bigger the explosion. that's the operative principle here. >> the israelis have been shown a video of the bomb being tested. it's the largest nonnuclear weapon in the pentagon's arsenal. those who saw the video say it was impresssive. demonstrating to the israelis that the u.s. now has the

ability to deal with iran's underground facility. on its first trip to israel as defense secretary last month, chuck hagel finalized a large conventional weapons deal that included state-of-the-art v-22 osprey aircraft and midair refueling tankers, but more importantly, did not include the mop. he discussed iran with his israeli counterpart. >> our position is iran will not be allowed to develop a nuclear weapon. the prevention of iran from developing a nuclear weapon, period. >> western intelligence believes iran has multiple nuclear facilities, including heavily fortified sites deep underground. hardened with steel and concrete. at least one facility is believed to be inside a mountain near comb. >> all military options and every option must remain on the table in dealing with iran. >> this sort of step, taking improvements on this very large

bunker busting bomb, which really only has one target, that buried nuclear facility called fordo in iran is one step to establish the military credibility. >> credibility that the pentagon hopes will discourage the israelis from acting alone against iran and send a message to iran that it should negotiate an end to its nuclear program. >> shannon: any information tonight about that military plane crash? >> well, it was a kc 135 refueling tanner, we're told. it had taken off from its base in central asia for a mission over afghanistan. the military has called off a search for tonight for the three missing pilots and crew. there is still no word to the cause of the crash. witnesses say the plane exploded in mid flight and broke into three pieces. >> shannon: all right, jennifer griffin, thank you. the last few south korean employees in north korea left the job today. i"pçy/6 signals the end of an at

>> shannon: fresh pickings from the political grapevine. defense officials are denying reports that the pentagon is considering a ban on service members sharing their faith. the president of a group in favor of court marshals for service members caught proselytizing said troops who do that are guilty of saidation and treason and should be punished. quote, it's a version of being spiritually raped by fundamentalist christian religious predators. following those comments, reports spread that the military would prosecute any christian service member who shared his or her faith. a claim the dod says is not true. quote, the u.s. department of defense has never and will never single out a particular religious group for persecution or prosecution. service members can share their

faith, evangelize, but must not force inwanted intrusive attempts to convert others to any faith. a man in new hampshire who admits to taking things from a store without paying says he's not a criminal because of the name of the store. surveillance video shows a man and a small child taking a grill off the porch of a thrift shop at night after the store was closed. he told police because the store is called finders keepers, he thought everything free. he also admits to taking a dvd player once before. he has agreed to return the items. finally, a misunderstanding led to some very awkward moments for a women's group in england. their guest speaker was a sea captain who had experience dealing with pirates. so the ladies dressed in full pirate regallon i -- regalia. but it was about his terrifying ordeal as a hostage by somali pirates in 2008. it was strange to be talking to

women dressed like this with rubber doingers. the pirates were appropriately embarrassed. but in the end, the captain agreed to be the judge for the best pirate costume competition. good sport. as we saw in the last story making cultural assumptions can be risky. now the story of something we normally don't associate here, but with a third world country. doug mckelway explains tonight, this time the action is just a short drive from washington, d.c. >> ice agents were called outside the home of a saudi military on tuesday to remove two philippino women who claimed he held them against their will, confiscated their passports and made them work long hours without pay. one reportedly escaped through a gap in the front gate as it was closing. >> the tip that we received that this was a labor trafficking, basically forced labor. we rescued over 30 victims just in the past two years in northern virginia. >> the saudi embassy did not respond to inquiries. the alleged defender has diplomatic immunity.

that so much new information has come out about what happened with the benghazi talking points, different modifications it went through, what's the deal in let's talk about it with our panel. jonah goldberg, juan williams, and pete wayneer. great to have you here. all of you. pete, we'll start with you. a great piece by steve hayes who is often a member of this panel detailing point by point the different versions of the talking points before they ultimately got into the version that ambassador susan rice used on the sunday shows. what do you make of what he's uncovered? >> that is a great story. it was an explosive story. it continues this narrative. what you had essentially was almost criminal negligence before and during the attacks on the u.s. consulate. what you have since then was misleading and lies. what steve's story does is add evidence. clearly they went lieu and removed things from the talking

points that was contrary to the narrative that they wanted to put forward, but was contrary to the facts. look, this scandal is like a time release capsule. it's unfolding more slowly than it should have because the white house did a good job covering it up. but i think the truth will rule out and the story and the hearing next week by the house i think is going to add a lot more information that we need to know about this. >> shannon: juan, what do you make of this? there are those who are critical of fox and other news organizations who have uncovered some of these items, but it appears now there is a clear path showing the different versions, the words that were taken out, the references to previous trouble and warnings in that area to islammic extremists. does the obama administration deserve criticism? >> i think that state department spokesman is pretty clear. we're not going to get into the

internal deliberations and everybody has internal deliberations about what they put out for public consumption. so the state department action today in dealing with james rosen, our fox correspondent was fox news is building a mythology and i think you hear that around town and obviously much of the main stream press is not paying attention to this story. so the question is, what is new? this week we've seen photos released by the government of three men that they now say they want more information about. it had not previously been released. i think fox is putting on pressure, certainly seems that it may have precipitated the release of those documents. similarly, what you see in terms of steve's reporting is it's based on documents that were used on the hill and came out of a hill report. all it does is it goes back and forth in terms of the traffic that was going on at the time as you had intelligence agencies preparing documents for public

officials like the ambassador, the u.n. ambassador, to come forward and then speak about it. now, is there mendacity as pete was suggesting? i don't see it yet. we're all reporters here. we're all looking for any smoking gun, any hard evidence. when we get it, i guess that will blow up a story. but right now i would say if you look at the investigation that was done by admiral mullen and ambassador pickerring, these are men with substantial credibility in this town. they said there was no conspiracy, no lies, no cover-up. if we find something like that, i'll be the first to come running. >> shannon: we see there was push back from the state department who didn't like the earlier versions that spelled out something very different than what the final talking points turned out to be. >> yeah. i agree entirely with juan that you get the sort of deliberations behind closed doors about what is going to be enough statement you put out to the public. what i think is interesting here are a couple things. first of all, there is no

mention in any of the drafts in this about the youtube video which this administration pushed rewill notlessly, blaming our first amendment for terrorism and there was launching this enormous debate about how much censorship we should allow to prevent hecklers veto in places like the middle east. mentioned it seven times at the u.n. none of that was ever in that. the c.i.a. never said this was part of it. what they did say was that this was al-qaeda. al-qaeda was part of it and that these islamic groups were part of it. that was taken out. and then later on when it was revealed that, in fact, al-qaeda was part of this all along and that the white house story wasn't true, the white house started blaming the intelligence agency saying oh, well, we didn't know that at the time. no, we did know. they did know that at the time. so i do think there is a considerable -- if you want to call it mendacity or imcompetence, i think reasonable people can disagree. but at the very least the

narrative that this administration put out from the very beginning has completely fallen apart and whether it was because of political pressure from the campaign, whether it was because hillary clinton wanted to cover herself and that's one of the reasons why she didn't speak to the arb, who knows? but the idea that fox is getting criticism for this strikes me as somewhat bizarre given the riot of skepticism that everything george bush did for eight years and now this strikes me as simply oversite and due diligence more than anything else. >> shannon: juan, would a gop president be treated differently if these same e-mails had come to light? >> i don't think so. i think what jonah said is true. everybody has internal deliberations with what you put out for consumption. if we're simply talking politics, i then think it invites people to say benghazi has been so politicized and being used by republicans to beat up on president obama. and i hope that's not the case. there is a legitimate story here, real questions to be

asked. many of them not yet answered. so i want to stay away from that construction. i just hope that any president facing an adversarial press would have to deal with questions like this. >> shannon: quickly, i want to play a little bit of what senator mccain said with greta on the record about questions about the accountability review board, what they put together, now the inspector general, possibly taking a look at that, here is senator mccain. >> you would think that one person at the c.i.a. or one person at the white house would have picked up the phone and said, hey, let me talk to one of these people who were in the fight and were taken to germany for treatment so that they could give their depiction of what happened. guess what? they didn't do that. >> shannon: juan, i have questions about why witnesses weren't interviewed, why secretary of state -- then secretary of state hillary clinton wasn't interviewed. pete, what do you make of that? >> look, i think what senator mccain said is important and it goes to steve's story which is this is not an isolated

event. this is part of a series of stonewalling events. i worked in the white house. i know the back and forth that goes into talking points. what is clear that happened here is what was originally reported or what was originally in the talking points was accurate and the state department and the white house went in and they took what was accurate out and jonah said, they fabricated a story about the youtube video, which was nowhere in the original report. with what juan said about if a republican president had done this. when george w. bush had given the famous 16 words in the state of the union speech, there was a fire storm of criticism. it turned out those 16 words were accurate. i can guarantee you if any of the last three presidents who were republican had been involved in a story like this, this would be front page every day in the "new york times" and most of the media outlets. it's disgraceful the way the media, with a few honorable exceptions like fox, has avoided this story. >> shannon: final word to you, juan, before a break.

>> small businesses have no idea what to do, what to expect. they don't know what affordability rules are. they don't know what families may apply. they just don't know. >> i just see a huge train wreck coming. we have discussed this many times and i don't see any results. >> i believe a country of our size, the only super power left in the world, it's not right that we have 50 -- we had, 50, 60 million people with no health insurance. we have to have a program where health insurance shouldn't go to the people that are rich. >> shannon: in that same radio interview, the senate majority leader harry reid, a democrat, of course, said unless this is implemented properly, it is going to be a train wreck, saying he agreed with senator max baucus. let's talk about it with jonahs, juan and pete. what do you make about this. democrats aren't only ones saying, this is maybe not going as well as we planned?

>> genuine anxiety. the white house is trying to tamp it down this week by trying to say they're making a big effort, in fact, finding money to get out information about how people can enroll, what you're coming up again is 2014. 2014 is when the mandate really kicks in in terms of you must have health insurance. it effects a very small number of people. most americans do have health insurance plans. but it's going to impact people and the people don't sign up, it could have a ripple effect in terms of the system. then you also have the issue of premiums. is it going to drive up the cost of health care? what about employers with more than 50 employees? could some employers decide they're going to reduce that number in order to satisfy the requirement? so all these issues are still kind of bubbling out there. but what you hear from democrats in the white house, not only us what officials, but people like steve israel, is republicans see this as some kind -- they think this is going to work. don't fall for it. in fact, there is a possibility

that things could go smoothly. the critical issue, making sure americans are aware of their benefits under the plan. right now polls show something close to 40% of americans aren't even aware that there is such a thing as the affordable health care act. >> shannon: jonah, it's interesting, there are some saying the gop did everything, it tried to do everything it could to make this look like a terrible thing. but it's the actual implementation that may be the thing that changes people's mind. >> god bless it. when the talking points fail and the marketing fails, the actual merits are going to have the proper teaching effect. i think -- president obama basically said as much, is that the parts that are going to affect most people have already gone into place. well, guess what? most people aren't feeling it. they don't feel like they're benefitting from it. instead, they think think it's bad. the fact there are a lot of people going to benefit from it who don't know anything about it is a sign of -- doesn't speak well of them, but also, we can talk about obamacare for a while

now. but i think this is one of these things where republicans should be careful and let events dictate things and let what i think will be a disaster prove itself in the fullness of time rather than trying to constantly spin it. >> shannon: you have to pass it to find out what's in it and sometimes it has to be implemented before everybody really understands what it will be. i want to switch, since this is lightning round, to our next topic. this is good news for the white house today on some counts. the jobs numbers today, because 165,000 jobs added. unemployment down. pete, sounds like a good thing. >> the jobs report was okay, but it's based on expectations. look, we're almost four years into a recovery. less than 200,000 jobs is not very good, especially since historically the worst a recession, the better the recovery. that hasn't been the case. the dow went over 15,000, that's quite good. as the dow is doing well, you've got a labor force participation rate which is the lowest since

1979 in growth, which is the key to driving jobs in america. is at the lowest, it's the worst economy for growth since 1929. since before the great depression. so jonah was talking about reality kicking in with health care, i think that's the case with the economy, too. i think this is a kind of mediocre jobs report for a mediocre economy. that has been the case for most of obama's term. >> shannon: one of the highlights is the youth unemployment rate and adjusted as a true effective rate, the generation opportunity group says unemployment for the younger generation is 16.1%. juan, what do you make of that? there are numbers inside of every report that won't be positive. but that's a group that overwhelmingly supports this president, has been a big fan of him. but they're graduating, it's graduation season and it's a 50/50 chance whether they'll get a job. >> it's not only that, it's whether or not they get a job that puts them on the path to

sort of getting a toe hold on the middle class life in this country. it's just going to be very difficult. i think you get 2 million newcomers to the job market every graduation season and what we have i think is already a back log of young people who feel like i've never had a meaningful job. i've been working at a coffee shop or some other place and living in my mom's basement and i would like to get a real job. so it's a tremendous source of frustration, especially if you look at minority kids. i think it's there 20 plus percent in terms of unemployment. these are not good numbers. this is the evidence, to me, of where things really are going to have a long-term effect, this recession, on the way that we americans live and on the american dream. >> shannon: jonah, inside the numbers, manufacturing not good. >> i don't think there are any manufacturing jobs, not increasing them. this job report is good. it's sort of saying it's like the best oktoberfest in orlando. >> shannon: that's my place of birth. don't be knocking on orlando.
